Caterer’s Agreement

Below is a Caterer’s Agreement which must be forwarded to your caterer as soon as possible. Your caterer must return this agreement, along with a security deposit and a certificate of insurance, no later than 30 days before your function. If you have not indicated the name of your caterer on your Building Use Application you must provide the Temple's Function Coordinator with this information, as well as the estimated number of guests, as soon as possible. Remember, you may not exceed the capacities of any Temple rooms. You, the renter, are responsible for providing your caterer will all forms and information, and for ensuring that forms and deposits are received on time. Your caterer may be denied access to the building if this information is not returned to the Rental Events Committee.

It is recommended that any caterer that has not done a function at the Temple previously should visit the facility to view the size and location relative to the available work area. Remember that the kitchen may only be used for dairy or pareve food.

This agreement is made between _______________________, hereafter referred to as “the Caterer,” and Temple Shir Tikvah, hereafter referred to as “the Temple.”

 

1.   The Caterer agrees to provide the Temple with a current Certificate of Insurance naming the Temple as an additional insured and showing proof of liability insurance, including product coverage and liquor liability coverage, of at least $1,000,000; and worker’s compensation coverage of at least $500,000. This Certificate must be provided to the Director of Administration (AD), along with this Agreement and a $100 Caterer’s deposit, at least 30 days prior to the date of the event. (Unless other arrangements have been made the deposit will be refunded within 30 days following approval by the Temple.)

 

2.   The Caterer will not have access to the Temple facilities prior to the date of the function. The Caterer cannot arrive earlier than one hour prior to the function and must depart the premises no later than one hour after the conclusion of the function, unless other written arrangements have been made with the Function Coordinator.

 

3.   With the exception of the tables and chairs which are available for use if desired, the Caterer will supply everything required for the function. The Caterer will not use any of the Temple’s other property, except as specifically provided by this Agreement.

 

4.   The Caterer shall designate an authorized representative who shall be present at all times to supervise the use of the Temple facilities during the function. A representative of the Temple will also be present during the function. At the conclusion of the function, the Caterer’s representative shall inspect the condition of the premises together with the Temple representative.

 

5.   The Caterer is responsible for the quiet and orderly conduct of its staff while using the Temple facilities.

 

6.   The Caterer agrees to abide by the following House Rules:

            (a)  Smoking is prohibited at all times throughout the Temple building.

(b)  No nails, tacks, tape, screws, or other means of fastening are to be driven into or placed in contact with any surface, including walls, windows, floors and furniture.

(c)  Food restrictions:

      Pork and shellfish are not permitted.

      Only fish that has fins and scales is permitted.

      Meat is not required to be Kosher.

      Milk products and meat may not be served in the same course.

      Milk products and meat may not be cooked together.

      The kitchen is a dairy kitchen, and may only be used for dairy functions with approval of the AD or Rabbinic Aide.

(d)  Aisles and exit doors must be kept clear. Chairs, decorations and flowers may not block aisles or exit doors or violate fire laws.

 

7.   If use of the kitchen is approved, the Caterer is responsible for returning the kitchen to the condition in which it was found. This includes washing the countertops and all kitchen equipment, sweeping and mopping the floor and removing all trash. If the Caterer uses another area in the facility from which to serve food, use of such area must be approved by the AD or the Rabbinic Aide; and the Caterer is responsible for returning that area to the condition in which it was found, including sweeping and/or mopping the floor and removing all trash. The temple's dumpster may not be used for trash disposal.

 

8.   The Temple will place tables in the Oneg Room upon request. It is the Caterer’s responsibility to place the chairs at the tables. Floor plans are available in the Temple Office. All set-ups must be completed in a manner that does not interfere with any services or activities that may be in session.

 

9.   The Temple shall not be liable for any personal injuries or loss of personal property of the Caterer or its employees.

 

10. No vehicles may be parked so as to obstruct the passage of an emergency vehicle or to block exits.

 

11. The Temple reserves the right to refuse admittance to any Caterer who fails to comply with the rules stated herein.

 

12. The Temple reserves the right to change, modify or cancel this agreement by sending thirty (30) days written notice to the Caterer. Such changes and modifications shall be deemed to be accepted by the Caterer unless the Temple receives written notice to the contrary within the (10) days thereafter. In the event either party cancels this agreement, there shall be no liability resulting thereby.

 

It is recommended that any Caterer that has not previously catered a function at the Temple should visit the facility to view the size and location of the kitchen relative to the available work area.
